    So, they dump this new regulation on the FFL and local police to carry out with no accounting for the extra workload but woe be to the FFL or local PD that screws it up! Typical of the Feds.

    5:30 So new law REQUIRES the buyers ADDRESS to FBI for all NICS checks! 7:48 The law as written said the “status” would not be returned until AFTER the address is submitted. 9:30 as clarified for 24hr rule as well.

    I literally bought a shotgun a week ago no issues. Came back proceed in like 30 seconds. Found a deal on a pistol today and delayed. Stupid. 24 year army vet still active and I’m delayed. So ignorant.

    When weren’t you delayed? Its pretty much routine at this point to go back to the FFL a second time to retrieve delayed status firearm, Wonder why. Hmmmmm.

    I have been on a delay since 05/05/22 , I asked my ffl if it was moved to open an I was told they don’t know what that means. Now there saying I should go get my canceled carry permit . This crazy I have owned gun all my life and now I have $1000 worth of guns just being held from me for I don’t know what reason. I live in Oregon, but have lived most of my life in California…

    I’ve been waiting since August 24 of this year with no update, or information besides an investigation is ongoing. I have no criminal record and a pretty unique name so I seem to be an outlier here. Either way, it would be nice to have an effective route to move forward. I’m stuck in this limbo and to cancle the order now the charges are around 450$. This was my first gun purchase and it has become a nightmare.

    I went to Cabela’s on Monday to buy my first handgun since I finally got my ltc in Massachusetts and I’m still waiting for an answer today marks day three hopefully I don’t get denied even tho I just got approved for my ltc.

    They are going to be checking against medical records for marijuana use in order to deny and prosecute. Nikki fried (Florida commissioner of agriculture) has a lawsuit challenging the law because of medical marijuana.

    I was a bit worried when I heard about this. I’d say of the last 8 firearms I have baught I was delayed everytime. Even with a concealed carry permit.

    I’m currently dealing with a "Research" status on a pistol purchase through PICS… Unreal. I’ve been a firearms owner for years and I have purchased 6 firearms in the past year without ANY issues… Suddenly now I get to play the "Wait 15 days" game 😒

    I have the classic common last name and I get put on delay about every third gun I purchase. I also of have a CCL. Last year I was purchasing a pistol at Northwest Armory in Milwaukie OR and while waiting on the background check the employee went ahead and rang up my purchase. Then I went in to delay mode. I live 80 miles away so this was a big pain since I was heading back home that afternoon. It ended up being 3 weeks on delay before they called and said I was good and could pick up my gun. I don’t think they should have taken my money before the background check had cleared, and when I mentioned that during a phone call to them during my delay period I was told I could come in and get my money back but they would charge me a restocking fee.

    I have an interesting story of my deniel. I was at the local FFL to purchase a gun cause I just opened a liquor store. They ran me into the NICS system and it came out as denial. I was really nervous and scared cause I had no idea why it happened. They gave me case number to appeal at the mentioned website, which I did and next morning I got an e mail stating the reason for the denial. Reason was " that I am an illegal Alien residing in the U.S unlawfully" . I sent in my paperwork and everything they asked for and next morning I got an email saying that I can go to the FFL with the printout of the email and take possession of the firearm.
    The FFL ran my name in the system again for his satisfaction and it came out with the Proceed status.
    So, NICs is not always accurate.

    So this is my real name and ive been denied. I have to fill out a paper and ill be going down to my local PD station so they can take fingerprints. Back when i was 17, i was young and dumb. I have 3 counts of Misdemeanor A – 943.01(1) Criminal Damage to Property – 939.05 PTAC, as a Party to a Crime — 943.20(1)(a) – Theft-Movable Property <=$2500 – 939.05 – PTAC, as a Party to a Crime – 943.20(3)(a) – Penalty-Theft if Value <=$2500 — 943.017(1) – Graffiti – 939.05 – PTAC, as a Party to a Crime. I dont know if this is affecting my denial or what but if it is, i can (Expunge) that record and it could take up to 3 months to remove it complelty from the database. Remember, this happend when i was 17. Im sure this has no effect of the denial. This isnt Misdemeanor crimes of domestic violence or Misdemeanor domestic abuse. Those are far worse then the crimes i commited back in 2007. Now this story is kinda messed up because i was 16 at the time when these were commited. I went to juvi court and they kept post poning my court date for a later time. Wisconsin waited till i was 17 and they put me in adult court. So if anyone has any oppions on this, please let me know because i would love to know if this is whats affecting me to get a gun.

    I always get delayed. I do end receiving my items purchased with no further delay. With this new information, will ffl dealer end also giving up all my info as well as info of purchased firearm serial numbers?

    In the past when done over the phone, I would get a "for further review." When done electronically I would get an immediate approval.

    I do have a bit of a history, but nothing that disqualifies me from buying a gun.
    My fid was held up a little while the local pd looked into it, and then I was cleared.
    I am in the process of expunging my embarrassing past, over 12 years a go, but am I going to get flagged on every nics check?

    Can I answer , to any of the Questions on the Background check
    I plead the 5th amendment
    I have that right , do I not.
    I have the right to keep and bear arms
    So can I just give
    Name, address, phone number
    SSN, and be done with the background check
    I mean, if I have done anything wrong
    I would have been arrested
    Tell you what, Investigate me..
    Call law enforcement and ask them about my history,
    I may make a mistake, in my memory of
    10, 20, 30, 40, 50, years ago
    But good thing, Government officials keep records….
    So why do I need to provide additional information about myself
    Just to see if we lie, when you check out the information….

    I had a "Denial" once, years ago… It was obviously a mistake on their part…. I think it was called a "Challenge Form" I had to fill out and file with the State Police… After a few days they called and said "sorry", "you’re good now"…. I’m glad they straitened it out, but it was still embarrassing as all Hell…. Gun store guys were looking at me like I was freaking Public Enemy #1 or something…. Haha!

    so why doesn’t NICS notify the FBI directly? they are on the other end of the phone with the FFL, are a government agency and have the information to give the FBI.

    is this just another way to trip up an FFL so they can revoke them?

When you fill out the FBI’s 4473 Firearms **Transaction Record** and an NICS is conducted…. your information automatically enters a federal database. Under the provisions of CFR § 25.9 Retention and destruction of records in the system…. QUOTE; "The FBI will maintain an automated NICS Audit Log of all incoming and outgoing transactions that pass through the system."

    If any gun shop owner violates your second amendment rights with background checks denying you the right to exercise your constitutionally protected second amendment rights (liberties) sue them under title 18 U.S.C. section 241 conspiracy against rights, and title 18 U.S.C. section 242 deprivation of rights under color of law. And sue the state under these laws and title 5 U.S.C. section 7311 Ex. ORD. No. 10450 section (5), title 18 U.S.C. section 1918, and 42 1983,1985.

    Why are there all these questions on the 4473, the FBI are doing a background check anyway, isn’t that the point of them searching the records? All that should be required are identifying information.

    Everytine i buy a gun i get delayed. I have a common last name and i use my ssn every time. I get a call saying i passed a few hours later….. am i on delayed lists?

    I’ve had both, denied and delayed. On the denied I had to pay $18. To the FBI to look into the denial plus a set of fingerprints $25. And $9. Postage. I received a call that following Friday from the gun shop and informed me that the FBI screwed up and I can pick up my pistol. That following Monday I received a letter from the FBI stating they did not deny my NICS. Several weeks later I purchased a receiver and a NICS check came back delayed. I was finally able to pick up the receiver five days later.
    This is ridiculous, I’m a retired veteran and Leo.

    That TEXAs bad guy – bought 2 DD ( 4 grand + $ ) and 1 G in ammo.. under 21 yrs old, cash.. approved?,.same day…no one questions him?.. but me, retired mil, with not even a parking ticket, gets hold for a day or 2?? how does this happen.. i even add my SSN..all the time.. i dont blame the workers.. i blame the lack of common sense
